1. Agreement

These Terms of Service (“Terms”) govern your access to and use of the website operated by SURPASSION Cigars (the “Site”). By using the Site, you agree to these Terms. If you do not agree, do not use the Site.

2. Eligibility & tobacco products

The Site markets premium cigars and related content. You may use the Site only if you are of legal age to purchase and use tobacco products in your jurisdiction (typically 21+ in the United States where applicable). We may use age-gating or other controls on the Site.

Surgeon General’s warning: Cigar smoking can cause cancers of the mouth and throat, even if you do not inhale, and can cause gum disease and tooth loss. Cigar use while pregnant can harm you and your baby.

3. No sale through this Site

Product availability, pricing, and purchase terms are determined by authorized retailers or channels we designate. Unless we expressly state otherwise, the Site is informational and does not complete retail sales directly. Links to third-party retailers are provided for convenience; their terms and privacy policies apply to transactions on their sites.

4. Acceptable use

You agree not to:

  • Violate any law or regulation;
  • Attempt to gain unauthorized access to our systems, other users, or networks;
  • Use the Site to transmit malware, spam, or misleading information;
  • Scrape, harvest, or automate access to the Site in a way that impairs performance or circumvents technical limits, without our prior written consent;
  • Misrepresent your identity or affiliation, or use the Site in any manner that could harm SURPASSION Cigars, our partners, or the public.

5. Intellectual property

The Site and its content (including text, graphics, logos, and design) are owned by SURPASSION Cigars or our licensors and are protected by copyright, trademark, and other laws. You may not copy, modify, distribute, or create derivative works without our prior written permission, except as allowed by law or for personal, non-commercial viewing.

6. User content

If you submit feedback, applications, or other materials through the Site, you grant us a non-exclusive, worldwide, royalty-free license to use, reproduce, and display such content as reasonably necessary to evaluate and respond to your submission and to operate our business, subject to our Privacy Policy.

7. Disclaimers

THE SITE AND CONTENT ARE PROVIDED “AS IS” AND “AS AVAILABLE.” TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE DISCLAIM ALL WARRANTIES, WHETHER EXPRESS, IMPLIED, OR STATUTORY, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SITE WILL BE UNINTERRUPTED OR ERROR-FREE.

8. Limitation of liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, SURPASSION Cigars AND OUR OFFICERS, DIRECTORS, EMPLOYEES, AND AGENTS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, DATA, OR GOODWILL, ARISING FROM YOUR USE OF THE SITE, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. OUR AGGREGATE LIABILITY FOR ANY CLAIM ARISING OUT OF THESE TERMS OR THE SITE SHALL NOT EXCEED THE GREATER OF U.S. $100 OR THE AMOUNTS YOU PAID US (IF ANY) FOR THE SPECIFIC SERVICE GIVING RISE TO THE CLAIM DURING THE TWELVE (12) MONTHS BEFORE THE CLAIM.

Some jurisdictions do not allow certain limitations; in those jurisdictions, our liability is limited to the fullest extent permitted by law.

9. Indemnity

You will defend, indemnify, and hold harmless SURPASSION Cigars and our affiliates from claims, damages, losses, and expenses (including reasonable attorneys’ fees) arising from your misuse of the Site or violation of these Terms.

10. Governing law & venue

These Terms are governed by the laws of the State of Florida, without regard to conflict-of-law rules. Subject to applicable mandatory consumer protections in your jurisdiction, you agree that exclusive venue for disputes shall be in state or federal courts located in Putnam County, Florida, unless we both agree otherwise.

11. Changes

We may modify these Terms at any time. The updated Terms will be posted on this page with a revised “Last updated” date. Continued use of the Site after changes constitutes acceptance of the revised Terms.
